The regulations will give effect to the Directive requirements, which apply emission controls to combustion plants with a rated thermal input equal to or greater than 1 MWth and less than 50 MWth (MCPs), irrespective of the type of fuel they use (which could include solid, liquid or gaseous waste). However, there are a number of exclusions (listed under Article 2 of the Directive), such as for plant subject to Chapter III (Large Combustion Plant) or Chapter IV (waste incineration/coincineration plant) of the Industrial Emissions Directive, and for specific types of plants.
